Refugee Protection Division (RPD) Canada

The Refugee Protection Division (RPD) is one of the four divisions of the Immigration and Refugee Board of Canada (IRB). It is responsible for deciding refugee protection claims made by individuals who are seeking protection in Canada.

Refugee claims are assessed under the Immigration and Refugee Protection Act (IRPA). The RPD determines whether a claimant qualifies as a refugee based on the evidence presented during the hearing process. Individuals who make refugee claims inside Canada may seek protection if they face serious harm in their home country, including persecution, risk to life, torture, or cruel and unusual treatment or punishment.

Refugee Protection Claims in Canada

Individuals already present in Canada may apply for refugee protection if they cannot return to their home country due to serious risks or persecution. The Refugee Protection Division assesses whether the claimant meets one of the two legal categories: Convention Refugee or Person in Need of Protection.

A Convention Refugee is a person who has a well-founded fear of persecution based on factors such as religion, political opinion, race, nationality, or membership in a particular social group. A Person in Need of Protection is someone who faces a risk to life, torture, or cruel and unusual treatment or punishment if returned to their home country.

Basis of Claim (BOC) Form

One of the most important documents in the refugee claim process is the Basis of Claim (BOC) form. The BOC form explains the reasons why the claimant cannot safely return to their home country. It outlines the claimant's personal history, the events that led them to seek protection, and the risks they face if returned. The information provided in the Basis of Claim form becomes a key part of the evidence considered during the refugee hearing.

Refugee Protection Division Hearings

If a refugee claim is determined to be eligible, the case is referred to the Refugee Protection Division of the Immigration and Refugee Board. During the refugee hearing, an IRB member reviews the evidence and may ask questions regarding the claimant's circumstances and the risks they face.

The hearing process typically involves: review of the Basis of Claim, examination of supporting evidence, consideration of country condition information, and questions from the decision-maker. After reviewing the evidence and testimony, the IRB member issues a decision regarding the refugee claim.

Possible Outcomes of an RPD Decision

After the hearing, the Refugee Protection Division may issue one of the following decisions: refugee protection granted, or refugee claim refused. If protection is granted, the claimant may become a protected person and may later apply for permanent residence in Canada. If the claim is refused, the claimant may have further options depending on the circumstances of the case.
