Common challenges on Indian files

The high volume of Indian files at IRCC means officers see the same patterns repeatedly — and the same weaknesses. Indian applicants have strong objective qualifications on average (high education levels, strong English, robust work histories), but a recognizable cluster of issues drives most refusals.

For study permits, the SOP is the single most-scrutinized document. Officers at New Delhi are explicitly testing whether the applicant has a credible career path in India that justifies the program — not just a desire to study abroad. SOPs that read like marketing copy or use AI-generated language are flagged. We rewrite the SOP until it would pass an officer reading 80 of them in a day.

GIC documentation is generally reliable for SDS applications, but financial-proof for non-SDS regular study permits is more sensitive. Officers want a steady savings buildup, not recent large transfers. Sponsor income (typically a parent) needs to be backed by ITRs (income tax returns), bank statements covering 6 months, and a clear letter of financial support.

Express Entry reference letters from Indian employers — especially Big Four consulting and large IT services firms — are well-known to IRCC officers. Templates are recognized; deviations from the firm's typical letter format raise questions. We draft reference letters that mirror NOC TEER duty statements but remain authentic to the employer's normal practice. Pay stubs and Form 16/26AS tax statements support the work-history claim.

OINP Tech Draw eligibility is the highest-leverage strategic question for Indian software professionals — picking the right NOC code (21232 vs 21233 vs 21234) and timing the EOI submission against the next draw can make the difference between a 2-month and 12-month wait.

Visa office serving India: New Delhi (with regional VACs in Mumbai, Bangalore, Chennai, Hyderabad, Chandigarh, Jalandhar, Ahmedabad)

All temporary resident applications from India are processed by IRCC New Delhi. PR applications follow the central federal queue, with biometrics and document submission through one of the regional Visa Application Centres (VACs).

Police certificates must be obtained through Passport Seva Kendra (PSK), and document translations from Hindi or regional languages must be certified by an authorized translator. Most professional-level documents from India are bilingual or already in English; for any in regional languages, certified English translations are mandatory.

Frequently asked questions — India

What is SDS and is my application processed faster under it?
The Student Direct Stream (SDS) ended on 8 November 2024. Indian applicants are now processed through the regular study permit stream. To put forward the strongest possible application, applicants should include a valid DLI letter of acceptance, a Provincial Attestation Letter (PAL) or Territorial Attestation Letter (TAL) where required, proof of financial support covering tuition and the current IRCC living-cost figure (CAD 22,895 for a single applicant, updated annually), a clear study plan, language results required by the DLI, and other country-specific checklist documents. A GIC is no longer an SDS pre-requisite but remains a strong way to evidence first-year living costs.
Should I use OINP Tech Draw or general Express Entry?
If you are a software professional with NOC 21232 or related codes and your CRS is below ~510, OINP Tech Draw is almost always the right answer. The +600 nomination effectively guarantees an ITA. For candidates with CRS above 530 in general draws, OINP may not add timeline value. We model both pathways for every Indian software-professional client.
Can my parents visit me in Canada on a Super Visa?
Yes. Super Visa is a 10-year multi-entry visa specifically for parents and grandparents of Canadian citizens or PRs. Each visit can last up to 5 years. The applicant (your parent) must show ties to India, financial capacity, and have minimum CAD 100,000 of valid medical insurance for 1+ year (from a Canadian or eligible overseas insurer meeting IRCC's conditions). How does NOC TEER classification work for Indian software developers?
Most Indian software developers fall under NOC 21232 (Software developers and programmers) or NOC 21233 (Web designers and developers) or NOC 21234 (Web developers and digital interface designers). Senior architecture and lead roles may be 20012 (Computer and information systems managers). NOC selection is the most consequential decision in your Express Entry profile — the wrong code can trigger refusal even with all-correct duty statements. We re-verify NOC for every Indian software client based on current job duties, lead-statement matching, and category-based draw alignment.
I had a TRV refusal — can I still apply for a study permit or PR?
Yes. Past refusals must be disclosed truthfully but do not bar future applications. We obtain GCMS notes (the officer's working file) for the prior refusal so we know exactly what concerns to address. Most refusal reasons can be overcome by a stronger application addressing the specific factor — what cannot be done is hiding the prior refusal, which becomes a misrepresentation finding and a 5-year ban.
Can spouses immigrate together or only one applies first?
For Express Entry and PNP, both spouses are listed on the same PR application — they land together as principal applicant + accompanying spouse. The other spouse can also have their own profile if their CRS is higher. For Spousal Sponsorship, the sponsor must already be a citizen or PR; outland from India is the typical route.
Do I need a degree from a recognized university?
Yes, for Express Entry. Foreign credentials need a positive Educational Credential Assessment (ECA) from WES, ICAS, IQAS, or ICES. Most Indian university degrees from UGC-recognized universities receive positive ECAs. We coordinate the ECA process from start to finish.
