1. Acceptance
These Terms govern your use of halaniimmigration.com (the "Site") and any digital services we provide. By using the Site, submitting our intake or contact form, or retaining our services, you agree to these Terms.
If you do not agree, please do not use the Site.
2. Who we are
Halani Immigration Services Inc. is a Canadian immigration practice operated by Shoukat Qumruddin Halani, RCIC-IRB, licensed by the College of Immigration and Citizenship Consultants (CICC), licence number R711322. We are authorized to provide immigration advice and representation under the Immigration and Refugee Protection Act and to appear at all divisions of the Immigration and Refugee Board (IRB).
3. No legal advice without a retainer
Information on this Site is general and informational. It is not legal advice. No solicitor-client or consultant-client relationship is created by your use of the Site, by submitting a contact or intake form, or by an initial consultation.
A consultant-client relationship begins only when you sign a written engagement letter (retainer agreement) and we accept it. The engagement letter sets the scope, fees, retainer, and obligations of both parties as required by CICC By-law 9.
4. Free assessments and consultations
We offer a free 5-minute eligibility assessment via the intake form at /apply. The output is an automated, non-binding read of typical fit for various pathways. It is not legal advice and may differ from the recommendation a consultant makes after a paid consultation.
We may decline to take on any matter, including after an initial assessment, at our sole discretion.
5. Fees and trust
Our professional fees are disclosed in writing in the engagement letter. All retainer funds are deposited into a designated trust account in accordance with CICC trust accounting requirements. Funds are released from trust as fee milestones are completed and the corresponding invoice is issued.
Government fees (paid to IRCC, ESDC, panel physicians, language testing centers, ECA bodies, etc.) are paid directly by the client. Where Halani pays a government fee on the client's behalf, it is paid from the client's trust funds and recorded in the trust ledger.
6. Client obligations
Clients must provide accurate, complete, and timely information; respond to document requests promptly; not misrepresent any fact to IRCC, IRB, or any other body; and follow our professional advice. Misrepresentation may lead to a 5-year ban under section 40 of the IRPA.
We rely on you to disclose all material facts relevant to your application. Failure to do so may compromise your application and is grounds for termination.
7. No guarantee of outcome
Immigration outcomes are determined by IRCC, IRB, ESDC, and other independent decision-makers. We cannot and do not guarantee any specific result. Our obligation is to provide competent, ethical representation and advice in accordance with the CICC Code of Professional Conduct.
8. Termination
Either party may terminate the engagement with reasonable notice as set out in the engagement letter. Upon termination we will refund unearned trust funds and provide a final accounting within 30 days. Original documents are returned per the CICC retention rules.
9. Communication and AI assistance
We may use AI tools (such as Claude) to assist with case summarization, document field extraction, and drafting communications. All AI-assisted output is reviewed and signed off by an RCIC before any client-facing use.
Communications between us are subject to professional privilege and are kept confidential per CICC obligations and the Privacy Policy.
10. Intellectual property
The content on this Site (text, logos, images, structure) is owned by Halani Immigration Services Inc. or its licensors. You may not republish or commercially exploit Site content without our prior written permission.
Engagement-letter templates, intake schemas, and case-management workflows we develop remain our proprietary work product.
11. Limitation of liability
To the maximum extent permitted by law, Halani's liability for any claim arising out of your use of the Site (separate from a signed retainer) is limited to direct damages and capped at CAD 100. The Site is provided "as is" without warranties.
Where a written retainer applies, the limits and indemnities in that retainer agreement govern.
12. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes are subject to the exclusive jurisdiction of the courts of Ontario, except that complaints regarding our professional conduct may be filed with the College of Immigration and Citizenship Consultants.
