Immigration and Refugee Board Representation Canada

The Immigration and Refugee Board of Canada (IRB) is an independent administrative tribunal responsible for making decisions on immigration and refugee matters under the Immigration and Refugee Protection Act (IRPA).

The IRB plays a central role in Canada's immigration system and decides cases involving:

Immigration Division (ID)

The Immigration Division deals primarily with immigration enforcement matters. Common hearings include admissibility hearings and detention reviews. Admissibility hearings determine whether a foreign national or permanent resident is inadmissible to Canada under IRPA. Detention reviews examine whether an individual held by immigration authorities should continue to be detained or released.

Immigration Appeal Division (IAD)

The Immigration Appeal Division hears appeals related to certain immigration decisions, including family sponsorship refusals, removal order appeals for permanent residents, and residency obligation appeals. The IAD has the authority to allow the appeal, dismiss the appeal, or provide equitable relief in certain circumstances.

Refugee Protection Division (RPD)

The Refugee Protection Division decides refugee claims made by individuals seeking protection in Canada. Refugee hearings assess whether a claimant qualifies as a Convention Refugee or a Person in Need of Protection. RPD members review evidence, testimony, and country conditions before issuing a decision.

Refugee Appeal Division (RAD)

The Refugee Appeal Division reviews certain refugee claim decisions made by the Refugee Protection Division. The RAD examines whether the original decision was reasonable based on the law and evidence. Appeals may involve review of the RPD decision, legal arguments challenging errors, and additional evidence in limited circumstances.
