Refugee Appeal Division (RAD) Canada
The Refugee Appeal Division (RAD) is one of the four divisions of the Immigration and Refugee Board of Canada (IRB). It reviews certain refugee claim decisions made by the Refugee Protection Division (RPD).
When a refugee claim is refused by the Refugee Protection Division, the claimant may have the right to challenge that decision through an appeal to the Refugee Appeal Division. The purpose of the RAD is to determine whether the original decision made by the RPD was reasonable based on the law and the evidence presented.
Halani Immigration Services Inc. provides professional guidance for individuals whose refugee claims have been refused and who may be considering an appeal to the Refugee Appeal Division. Our services are led by Shoukat Qumruddin Halani, RCIC-IRB, authorized to represent clients before the IRB and licensed by the CICC under License No. R711322.
Refugee Appeals in Canada
A refusal of a refugee claim does not always mean the process has ended. In certain circumstances, claimants may appeal the decision to the Refugee Appeal Division. The RAD reviews the decision made by the Refugee Protection Division and considers whether the original decision contained errors related to: interpretation of the evidence, application of the law, or assessment of the claimant's credibility.
The Refugee Appeal Division generally reviews the written record from the RPD and may also consider additional evidence in limited situations.
Who May Appeal to the Refugee Appeal Division
Not all refugee claimants have access to the Refugee Appeal Division. Eligibility to file an appeal depends on several factors related to the claimant's situation and the circumstances of the claim. Individuals who receive a refusal from the Refugee Protection Division should carefully review their options as the refugee appeal process involves strict filing deadlines. Understanding whether an appeal is available and how to proceed is an important step after receiving a negative refugee decision.
Possible Outcomes of a Refugee Appeal
After reviewing the case, the Refugee Appeal Division may issue one of several outcomes. The RAD may: confirm the decision made by the Refugee Protection Division; set aside the original decision and substitute a new decision; or return the case to the RPD for a new hearing. Each appeal is assessed based on the evidence in the record and the applicable provisions of Canadian immigration law.
