Immigration Division (ID) Canada

The Immigration Division (ID) is one of the four divisions of the Immigration and Refugee Board of Canada (IRB). It is responsible for hearing certain immigration enforcement matters under the Immigration and Refugee Protection Act (IRPA).

The Immigration Division primarily deals with two types of proceedings: immigration detention reviews and immigration admissibility hearings. These proceedings usually arise when immigration authorities believe that a foreign national or permanent resident may be inadmissible to Canada or when an individual has been detained under immigration law.

Immigration Detention Reviews

A detention review hearing takes place when an individual has been detained by the Canada Border Services Agency (CBSA) under the Immigration and Refugee Protection Act. The Immigration Division reviews whether the person should remain in detention or be released under certain conditions. Detention reviews normally occur at regular intervals after detention begins.

During the hearing, the Immigration Division considers factors such as: identity verification, risk of flight, public safety concerns, and cooperation with immigration authorities. The purpose of the detention review is to determine whether continued detention is justified under Canadian immigration law.

Admissibility Hearings

An admissibility hearing is conducted when immigration authorities believe that a foreign national or permanent resident may be inadmissible to Canada. Inadmissibility may arise for several reasons under IRPA, including misrepresentation, criminality, serious criminality, security concerns, or violation of immigration conditions.

During the admissibility hearing, the Immigration Division reviews evidence presented by the CBSA and determines whether the person is inadmissible under Canadian immigration law. If inadmissibility is established, the Immigration Division may issue a removal order.

Possible Outcomes of Immigration Division Hearings

After reviewing the evidence and hearing submissions, the Immigration Division may issue decisions such as: release from detention with conditions, continued detention, determination that the individual is inadmissible, or issuance of a removal order. The outcome may affect an individual's ability to remain in Canada.
