Discretionary LMIA-exemption code under IRPR s.205(a) when the foreign worker's work creates significant social, cultural, or economic benefit to Canada. Used for high-profile professionals, researchers, executives, and others where standard categories don't fit but the benefit case is clear.
What is C16?
C16 is the general LMIA-exemption code for "significant benefit" cases under IRPR s.205(a). It's a discretionary catch-all when the worker's role creates measurable benefit but doesn't fit standard categories (C11 entrepreneur, C12 ICT, GTS, etc.).
When C16 applies
Typical scenarios:
- Senior researchers and academics at Canadian institutions
- High-profile executives transferring to a Canadian role outside ICT criteria
- Specialized consultants brought to Canada for time-limited projects
- Cultural / artistic exchanges of significant national interest
- Visiting professors at universities (often paired with C11 or specific academic exemptions)
The "significant benefit" test
Officer must conclude that the work creates significant social, cultural, or economic benefit to Canada. Evidence typically includes:
- Awards, publications, or industry recognition
- Financial impact (revenue, investment, jobs created)
- Cultural / artistic contribution (peer endorsements, prior shows/exhibits)
- Unique skills not readily available in Canada
Documentation
Strong C16 applications include:
- Detailed offer letter explaining the unique role
- Supporting letters from Canadian industry / academic peers
- Evidence of past achievements (CV, awards, publications)
- Business case showing the benefit to the Canadian organization
Duration
C16 permits are typically issued for the duration of the engagement — often 1-3 years initially with possible extension.
