C12 — Intra-Company Transferee Work Permit

An LMIA-exempt work permit code for managerial, executive, and specialized-knowledge employees being transferred from a multinational's foreign branch to its Canadian branch. One of the most-used LMIA-exemption categories for Indian, Pakistani, and Gulf-based IT and corporate professionals.

What is C12?

C12 is an LMIA-exemption code under IRPR s.205(a) — the broader "significant benefit" / "general LMIA-exempt" provision — and is specifically used for Intra-Company Transferees (ICT). Under international agreements like CUSMA, additional ICT categories exist with their own codes (C61, T22, etc.).

Who qualifies for C12 ICT

To qualify under C12 ICT, you typically must:

  • Have worked for the foreign branch of the multinational for at least 1 year continuously in the last 3 years
  • Be transferring to a Canadian branch of the same enterprise (parent, subsidiary, branch, or affiliate)
  • Be transferring in one of three role categories:
    • Executive (directs the management of the organization or major function)
    • Manager (manages an essential function or department)
    • Specialized Knowledge (proprietary knowledge of the company's products, processes, or systems that is not widely available)

Common C12 fact patterns

  • Indian IT services companies (Infosys, TCS, Wipro, Tech Mahindra, HCL, Cognizant) transferring staff from Indian offices to Canadian client sites
  • Global tech firms (Microsoft, Oracle, IBM, Cisco) transferring engineers from Dubai / Bengaluru / Mumbai to Canadian offices
  • Financial services firms transferring DIFC-based analysts to Toronto offices
  • Consumer-goods multinationals transferring brand managers

Maximum duration

C12 ICT permits are typically issued for up to 3 years initially, with the possibility of extensions:

  • Executives/Managers: total up to 7 years
  • Specialized Knowledge workers: total up to 5 years

Spouse and children

C12 ICT permit holders' spouses are eligible for a Spousal Open Work Permit (SOWP). Children attend Canadian K-12 schools without separate study permits.

C12 to PR

C12 ICT work counts as Canadian work experience for Express Entry CEC (if the role is TEER 0/1/2/3). Most ICT holders transition to PR through CEC + PNP backstop within 18-30 months of arrival.
