Status Extension in Canada
Temporary residents who are already in Canada may need to extend their legal immigration status in order to remain in the country lawfully.
Foreign nationals in Canada as visitors, workers, or students must ensure their immigration status remains valid during their stay. If additional time is needed in Canada, individuals may apply for a status extension or change of conditions before their current status expires.
Halani Immigration Services Inc. provides professional guidance for individuals seeking to extend or restore their temporary status in Canada. Our services are led by Shoukat Qumruddin Halani, RCIC-IRB, a Regulated Canadian Immigration Consultant licensed by the CICC under License No. R711322.
What Is a Status Extension in Canada
A status extension allows a temporary resident already in Canada to remain legally in the country beyond the original authorized period.
For visitors, this is usually done by applying for a Visitor Record, which extends the authorized stay in Canada and sets a new expiry date for leaving Canada. A Visitor Record is not a visa — it is a document issued by IRCC or the Canada Border Services Agency (CBSA) that allows a person to stay longer in Canada.
Most visitors are initially allowed to stay in Canada for up to six months, unless another expiry date is indicated in their passport stamp or permit.
When You Should Apply for a Status Extension
Temporary residents should normally apply to extend their status before their current status expires. IRCC recommends applying at least 30 days before the expiry date of your authorized stay in Canada.
The expiry date of your status may be shown on:
- Your passport entry stamp
- Your visitor record
- Your study permit
- Your work permit
If you apply before your status expires, you may benefit from maintained status, meaning you can remain in Canada under the same conditions until a decision is made on your application.
Types of Status Extensions in Canada
Visitor Record Extension
Visitors who wish to remain in Canada longer may apply for a visitor record, which allows them to extend their stay beyond the usual six-month period.
Study Permit Extension
International students may apply to extend their study permit if they need more time to complete their academic program.
Work Permit Extension
Foreign workers may apply to extend their work permit if they have continued employment authorization in Canada.
Change of Conditions
Temporary residents may apply to change their immigration conditions, such as changing from student to visitor, from worker to visitor, or changing restrictions on their stay. These applications are submitted through IRCC using IMM 5708.
Restoration of Status in Canada
If a temporary resident loses their legal status in Canada, they may still have an opportunity to apply for restoration of status. Individuals may apply for restoration within 90 days of losing their status, provided they meet the eligibility requirements.
Restoration applications must include:
- An explanation of why status was lost
- A completed restoration application
- Payment of restoration fees
Approval of restoration is not guaranteed, and applicants must demonstrate that they meet the requirements to remain in Canada.
Important Considerations
Temporary residents should carefully manage their immigration status while in Canada.
- You must apply before your status expires to remain legally in Canada
- Extending your stay does not automatically renew your visa or eTA
- A visitor record allows you to stay longer but does not guarantee re-entry into Canada if you leave the country
- Maintaining legal status is essential for anyone wishing to continue their stay in Canada
