Canadian Citizenship Application Refused — Recovery

Most common citizenship refusal grounds

Physical presence shortfall (top ground)

Officer determined you didn't have 1,095 days physical presence in Canada within the 5 years preceding application. Often the days you claimed don't match CBSA's travel-history records. Language proof inadequate

Applicants aged 18-54 must demonstrate CLB 4+ in English or French. If your language evidence wasn't acceptable, the application can fail. Fix: Submit a clearly-accepted language evidence type (IELTS / CELPIP / TEF / TCF / Canadian high school diploma / etc.) and reapply.

Citizenship test failure

If you failed both attempts (first + second) and the oral hearing alternative, the application is refused. Fix: Study Discover Canada more thoroughly, reapply (no waiting period), retake the test with better preparation.

Prohibitions under the Citizenship Act

Citizenship is prohibited if you:

  • Are serving a sentence (imprisonment, probation, parole, conditional sentence)
  • Are charged with certain offences
  • Are subject to a removal order
  • Have been convicted of certain offences within the prohibition period
  • Were involved in misrepresentation or fraud in any prior immigration application

Fix: Most prohibitions are time-limited. Wait out the prohibition period, then reapply.

Tax filing incomplete

You must have filed income tax returns for at least 3 of the 5 years preceding application (if required to file under the Income Tax Act). Missing filings can be cured by filing late returns + reapplying.

Federal Court judicial review of citizenship refusals

You can apply for judicial review of a negative citizenship decision within 30 days of receipt. The Federal Court reviews whether the citizenship officer made a legal error or unreasonable factual finding.

JR is appropriate when: the officer ignored evidence, miscalculated physical presence using wrong dates, applied wrong legal test, etc. JR is NOT appropriate for substantive disagreement on the merits.
