BOWP refusals are particularly stressful because they can put PR applicants out of status during processing. This page covers the common refusal grounds + how to address them in reapplication or pivot to alternative work permits.

Standard recovery sequence

  1. Confirm current status (in valid status or already in restoration window?)
  2. Order GCMS notes via ATIP — understand specific refusal grounds
  3. Decide path: reapply BOWP (if correctable), pivot to alternative work permit, or maintain status without work
  4. Act within applicable timelines

Most common BOWP refusal grounds

1. No PR application AOR (most common)

BOWP requires Acknowledgement of Receipt (AOR) for PR application. Common scenarios:

  • Express Entry profile created but no ITA yet — BOWP not available (only post-ITA)
  • PR application submitted but AOR not yet received
  • PR application rejected at intake stage

Fix: Wait for AOR before applying for BOWP, OR pursue alternative work permit if PR is more than 4 months out.

2. Current work permit not expiring within 4 months

BOWP applied for too early. If your current permit expires in 8 months, you may have applied for BOWP today + IRCC refused as premature.

Fix: Reapply when within 4 months of expiry.

3. Ineligible PR program

BOWP is only available for specific PR programs:

  • Express Entry (post-ITA)
  • PNP (with provincial nomination)
  • AIP (with confirmation of acceptance)
  • Quebec QSWP/PEQ (with CSQ)
  • RCIP, FCIP, HCWP (Home Care Worker Pilots)
  • Caregiver legacy pilots

If you're applying for other PR pathways (e.g., spousal sponsorship outland), BOWP doesn't apply.

Fix: If on spousal sponsorship inland (not outland), special open work permit applies (separate from BOWP). For other cases, alternative work permits.

4. Not in Canada / not in valid status

BOWP requires you be IN Canada with valid status at time of application.

Fix: If you've fallen out of status, restoration first (within 90 days). If outside Canada, apply for relevant outside-Canada work permit.

5. Inadmissibility issues

Criminal, medical, security inadmissibility can refuse BOWP.

Fix: Address underlying inadmissibility (TRP, criminal rehabilitation, etc.).

6. Application form mistakes

Wrong forms, incomplete sections, missing supporting documents.

Fix: Submit corrected reapplication with complete documentation.

Recovery options

If still in valid status

You have time to:

  • Reapply for BOWP with corrections (if eligibility issue resolved)
  • Apply for alternative work permit (LMIA, ICT, GTS, CUSMA — whichever applies)
  • Apply for visitor record to remain in Canada (no work authorization)

If status expired + within 90-day window

Apply for Restoration of Status immediately. During the 90 days, you have NO work authorization. See Restoration of Status.

If 90 days has passed

You must leave Canada. Or pursue H&C application or other special considerations.

Alternative work permits (when BOWP isn't viable)

LMIA-based closed work permit

Employer obtains LMIA + you apply for closed work permit. Slower (5-9 months total) + LMIA fees. But independent of BOWP eligibility. See LMIA.

ICT (Intra-Company Transfer)

If you work for multinational with both foreign + Canadian entities. LMIA-exempt. 4-12 weeks IRCC processing. See ICT vs LMIA.

GTS (Global Talent Stream)

For tech roles at GTS-eligible employers. 2-week LMIA + 2-week work permit. Very fast. See GTS.

Visitor record (no work)

If no work permit option available, visitor record extends status as visitor (no work). Useful for buying time while pursuing other pathways.

Common BOWP refusal mistakes

  • Applying for BOWP without confirmed AOR
  • Applying too early (before 4-month expiry window)
  • Confusing BOWP with general open work permit (not interchangeable)
  • Letting status expire during BOWP processing without contingency plan
  • Not pursuing alternative work permits in parallel

Why was my BOWP refused?

Most common: (1) No AOR for PR application — BOWP requires acknowledged PR application; (2) Current work permit not expiring within 4 months; (3) Ineligible PR program (BOWP only for specific programs — Express Entry post-ITA, PNP nomination, AIP, etc.); (4) You're not in Canada with valid status; (5) Inadmissibility issues; (6) Mistakes on application form.

Can I reapply for BOWP?

If the refusal was procedural or based on correctable issues, yes. Order GCMS notes via ATIP to understand specific concerns. Address them in reapplication. If you genuinely don't qualify (e.g., no PR application AOR), you need alternative work authorization.

What if I'm no longer in valid status due to BOWP refusal?

Critical situation. If current work permit has expired during BOWP processing + BOWP refused, you're now without status. Within 90 days, can apply for Restoration of Status. Beyond 90 days, you must leave Canada.

What alternatives if BOWP isn't available?

LMIA-based closed work permit (employer needs LMIA, 5-9 months total), ICT if multinational employee, GTS if tech role, CUSMA Professional if US/Mexican citizen, IEC Working Holiday if age-eligible + country eligible.

Does BOWP refusal affect PR application?

BOWP refusal itself doesn't directly affect PR application. PR application continues processing independently. But if BOWP refusal puts you out of status + you have to leave Canada, that can complicate PR application (especially Inland sponsorship where presence in Canada matters).
