SOWP for spouse of skilled worker

Spouse/CLP of a foreign worker in Canada. Post-January 2025 restrictions:

Eligible: Spouse of worker in TEER 0 or TEER 1 occupation
Eligible: Spouse of worker in TEER 2 or TEER 3 in specialized sectors (healthcare, construction, natural + applied sciences, education)
NOT eligible: Spouse of worker in TEER 2/3 outside specialized sectors
NOT eligible: Spouse of worker in TEER 4 or TEER 5

SOWP for spouse of international student

Spouse/CLP of a study permit holder. Post-January 2025 restrictions:

Eligible: Spouse of student in Master's degree program
Eligible: Spouse of student in PhD program
Eligible: Spouse of student in eligible professional degree (law, medicine, dentistry, pharmacy, optometry, veterinary medicine, chiropractic, others)
NOT eligible: Spouse of student in most college diploma + undergraduate degree programs
NOT eligible: Spouse of student in language training or short certificates

SOWP for spouse of inland sponsorship applicant

Spouse/CLP of a Canadian citizen/PR sponsor, where the principal applicant has filed an inland sponsorship application + their PR application is being processed. Open work permit issued while PR is processed. No TEER/program restrictions — this is a different category from the above.

Common eligibility for all SOWP categories

Principal applicant has valid status (work permit, study permit, PR application acknowledgement)
Spouse/CLP relationship verified (marriage certificate or common-law evidence)
Spouse is admissible (no inadmissibility)
Spouse intends to leave Canada when status expires

Application process

Verify principal applicant's status meets SOWP category requirements
Spouse applies for SOWP via IRCC online portal — IMM 5710 work permit application
Pay fees: CAD $155 work permit + CAD $100 open work permit holder fee = $255 total
Submit supporting documents:
- Principal applicant's work/study permit (or PR application AOR)
- Marriage certificate OR common-law evidence (12+ months cohabitation)
- Passport
- For overseas applicants: spousal relationship genuineness evidence
Biometrics if required
IRCC processes: 4-12 weeks (varies by location + complexity)

Study at DLI (need a study permit)

When SOWP isn't available — alternatives

If you don't qualify for SOWP under the 2025 restrictions, options:

LMIA-based closed work permit — employer obtains LMIA + spouse applies for closed WP. Slower (5-9 months) but independent of principal
IEC Working Holiday — if spouse is 18-35 + from IEC bilateral country
Visitor record — spouse remains in Canada as visitor (no work authorization)
Accelerate principal's PR — once principal becomes PR, full spousal sponsorship + OWP pathway opens

SOWP validity + renewal

SOWP generally matches principal applicant's permit validity. When principal renews their permit, spouse applies to renew SOWP with updated documents. SOWP renewal is routine when principal's status is maintained.

What happens if principal applicant's status changes

Principal becomes PR: Spouse no longer needs SOWP; pursues spousal sponsorship or accompanying-dependent processing
Principal's permit refused/expired: SOWP also ends. Spouse needs alternative work authorization
Relationship ends: SOWP ends. Spouse needs to apply for separate work authorization (or leave Canada)
Principal moves to different program/employer: SOWP renewable if new principal status meets eligibility

Major eligibility tightening. (1) Spouses of foreign workers only qualify if principal is in TEER 0/1 OR specialized sector (healthcare, construction, natural sciences, education) in TEER 2/3. TEER 4/5 worker spouses largely excluded. (2) Spouses of international students only qualify if principal is in Master's, PhD, professional degree, or specific program. Most college diploma + undergraduate student spouses no longer qualify.

How long is SOWP valid?

Generally matches the validity of the principal applicant's permit. If principal's work permit expires June 2027, SOWP also expires June 2027. Renewable when principal's permit is renewed.

Can SOWP holder work for any employer?

Yes — SOWP is an open work permit. Any Canadian employer, any role (with limited exceptions like adult entertainment in some provinces).

Does SOWP count toward Canadian work experience for PR?
