PR Card Renewal Refused — Don't Panic, You Still Have Status
A PR card renewal refusal usually means IRCC has flagged a residence-obligation issue — the 730-day physical-presence requirement isn't met. You haven't automatically lost PR status; you have appeal rights. This page covers the IAD appeal strategy and emergency options.
Important: you're still a PR until removal is enforced
A refusal of PR card renewal does NOT automatically take away your PR status. PR status is lost only when:
- A removal order against you becomes enforceable (after appeals exhausted)
- You formally renounce PR
- You become a Canadian citizen (voluntary loss)
You can still live, work, study, and receive provincial healthcare in Canada — but your card has expired, which limits travel.
The 730-day residence obligation
PRs must be physically present in Canada for **730 days within each 5-year period**. This is the most common refusal trigger. Pre-PR time doesn't count. Time as a PR outside Canada under specific circumstances may count (working abroad for a Canadian business, accompanying a Canadian-citizen spouse abroad).
The 30-day IAD appeal
Within **30 days** of receiving the refusal letter, you can file an appeal to the **Immigration Appeal Division (IAD)** of the Immigration and Refugee Board. The IAD:
- Conducts a **de novo hearing** — new evidence admissible
- Considers **H&C factors** under s.28(2)(c) IRPA — humanitarian and compassionate considerations
- Can **set aside the refusal** and allow your PR to continue
- Can **uphold the refusal** but grant a stay of execution while you work toward compliance
H&C factors the IAD considers
- Extent of breach — how short of 730 days you are
- Reasons for time outside Canada — work, family, caregiving for elderly relatives, health
- Best interests of any Canadian-born children who would be affected
- Establishment in Canada — property, employment, community ties before / after the breach
- Hardship of leaving Canada if removed
- Time elapsed since the breach and any compliance since
If you're abroad when you get the refusal
You need a **Permanent Resident Travel Document (PRTD)** to fly to Canada — apply at a Canadian visa office abroad. PRTD application will be assessed against the same residence-obligation criteria as PR card. If refused, you can still appeal to the IAD from abroad and request the appeal continue in your absence (or in person if you can travel via the US land border).
