Most common PGWP refusal grounds in 2025-2026
Program eligibility (top ground)
2024-2025 rules restricted PGWP to public DLIs + private DLIs offering degree programs + specific eligible private-college programs. Graduates of non-eligible private-college programs are being refused. Fix: Verify program eligibility against the current IRCC list before applying. If your program is no longer eligible and you graduated after the restriction took effect, alternative work-permit pathways (LMIA-based) may be your route.
Late application (past 180 days)
You must apply within 180 days of receiving graduation confirmation, AND have a valid study permit at some point in the 180 days. Late = automatic refusal. Fix: No reapplication possible if you genuinely missed the window. Pursue alternative work permits.
Language requirement (since Nov 2024)
CLB 7 (university graduates) or CLB 5 (college graduates) is now required. Applications submitted without an approved English / French test result that meets the threshold are refused. Fix: Take or retake IELTS / CELPIP / TEF / TCF and reapply.
Failure to maintain student status
You must have maintained full-time student status throughout your program. Withdrawals, part-time periods, or unauthorized leaves can disqualify you. Fix: Depends on the specific issue; some files can be salvaged with explanations of authorized leave or fall-term breaks.
Incomplete application package
Missing language test, missing transcripts, missing biometrics. Fix: Reapply with the complete package within the 180-day window if possible.
What to do if PGWP is not recoverable
- LMIA-based work permit — find a Canadian employer willing to obtain an LMIA for you
- Provincial PNP graduate stream (varies by province) — some accept non-PGWP graduates
- Return to country of nationality + Express Entry FSW with strong CRS
- Family-class sponsorship if you have a Canadian spouse / partner
Status implications
When your study permit expired and PGWP was refused, your status ends. You typically have:
- Implied status during PGWP processing (if applied before study permit expiry) — ended with the refusal
- Restoration of status: 90 days from status loss to apply for a new permit + pay restoration fee (cannot work during restoration)
- After 90 days: must leave Canada and reapply from outside

Can I reapply for a PGWP after refusal?

How long after a PGWP refusal can I stay in Canada?
Your status ended when your study permit expired (which is what triggered the PGWP application). If you applied for PGWP before study permit expiry, you had implied status that ended with the refusal. You may have a short window to apply for restoration of status (90 days from status loss) OR you must leave Canada.
Can I apply for judicial review of a PGWP refusal?
