Inland Sponsorship — Spousal/Common-Law Sponsorship Inside Canada
Spousal or common-law sponsorship where the sponsored spouse is already in Canada with valid status. Includes an Open Work Permit (OWP) during processing. The sponsored spouse must remain in Canada throughout — leaving and re-entering on visitor status creates risk.
What is inland sponsorship?
Inland sponsorship is spousal or common-law partner sponsorship where the sponsored spouse is already physically in Canada with valid temporary status (visitor, work permit, study permit) at the time of application. Distinct from outland sponsorship where the sponsored spouse is overseas.
Key features of inland sponsorship
- Sponsored spouse is in Canada at application + during processing
- Sponsored spouse is eligible for an Open Work Permit (OWP) during processing — allows full-time work for any Canadian employer
- Sponsored spouse must remain in Canada throughout processing — leaving and re-entering creates re-entry risk (visitor status / TRV issues)
- No appeal right to the IAD if inland sponsorship is refused — only Federal Court judicial review
Why choose inland
- Sponsored spouse can work in Canada during processing (typically 10-12 months)
- Family unity throughout the process — no separation
- Existing temporary residence + integration in Canada
Why choose outland instead
- IAD appeal right if refused (significant)
- Sponsored spouse can travel freely (no re-entry risk)
- Often faster processing at certain country visa offices
- No requirement to remain physically in Canada
The OWP during inland processing
The sponsored spouse can apply for an Open Work Permit alongside the inland sponsorship application. Typical processing time: 60-180 days for the OWP, then 10-12 months for PR.
The OWP is open — can work for any employer in any occupation (with limited exceptions for certain regulated professions and child/eldercare requiring medical clearance).
Risks specific to inland
- Status maintenance: sponsored spouse's temporary status must be valid at application and ideally throughout processing. Status lapses create restoration issues.
- No travel: leaving Canada during inland processing is high-risk. Re-entry as a visitor while a PR application is pending can be questioned at port of entry.
- No IAD appeal: refusal = federal court only.
Halani's note
Choice between inland and outland depends on the specific situation — sponsored spouse's existing status, work needs, travel needs, country of nationality visa office processing pattern, and appeal-right considerations. We map this at consultation.
